Terms of Service

1. Description of the Service

StreamGenie provides tools to connect your social accounts and manage uploading, processing, and distribution of your video and related content to platforms you select, including storage in the Troveo.ai S3 bucket that you configure.

2. Eligibility and Accounts

• You must be at least the age of majority in your jurisdiction.
• You are responsible for the accuracy of your account information and for safeguarding access tokens and credentials used with the Service.
• You will notify us promptly of any unauthorized use of your account.

3. Social Account Connections and Upload Permissions

By connecting your social account(s) to the Service, you expressly authorize StreamGenie to act on your behalf to upload, transmit, process, and manage your content to the Troveo.ai S3 bucket that you have provided or configured, and to any connected third-party platforms you choose. This authorization includes the use of the access tokens you grant to perform these actions programmatically.

For the limited purpose of operating, improving, and providing the Service, you grant StreamGenie a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, cache, reproduce, transcode, adapt, communicate, and display your content solely as necessary to provide the Service to you and your connected destinations. Except for this limited license, you retain all ownership rights in your content.

4. Your Content and Warranties

• You represent and warrant that you own all content you upload to or through Troveo.ai via the Service, or you have all necessary rights, licenses, and permissions to upload, use, and authorize StreamGenie to process and distribute that content as described in these Terms.
• You will not upload content that infringes, misappropriates, or violates any intellectual property, privacy, or other rights; is illegal or harmful; contains malware; or otherwise violates these Terms.

5. Relationship to Troveo.ai Terms

Where these Terms are silent, StreamGenie’s practices align with the prevailing Troveo.ai Terms of Service. You are responsible for complying with Troveo.ai’s terms and policies when using Troveo.ai services. If there is a conflict between those terms and these Terms, these Terms govern your relationship with StreamGenie.

6. Payments and Subscriptions

• Paid plans are billed via Stripe and may auto-renew until canceled.
• Fees, features, and limits are described at checkout or within your account settings. Unless required by law or stated otherwise, charges are non-refundable.
• You may cancel at any time; cancellation takes effect at the end of the current billing period.

7. Privacy

We do not collect or store personal data beyond what is required for payment processing through Stripe. Payment information is collected and stored by Stripe, not by StreamGenie. StreamGenie stores only the following about you:

• Social account identifiers and tokens necessary to publish on your behalf
• Metadata and references for videos and related assets you upload
• Your subscription status
• The email address you provide at sign-up

We do not store your full payment card details. Use of Stripe is subject to Stripe’s terms and privacy policy.

8. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect information within our control. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Acceptable Use

• No illegal, infringing, fraudulent, or harmful activity.
• No attempts to bypass security or interfere with the Service’s operation.
• No scraping or rate abuse beyond documented API limits (if any).

10. Intellectual Property

StreamGenie and its licensors own all rights in the Service and associated software, trademarks, and content (excluding your content). No rights are granted except as expressly stated.

11. Third-Party Services

The Service integrates with third parties such as Troveo.ai and Stripe. Your use of those services is governed by their terms and policies. We are not responsible for third-party services and disclaim all liability arising from your use of them.

12. DMCA / Copyright Complaints

If you believe content uploaded through the Service infringes your rights, you may contact us with sufficient detail to locate and assess the material. We may remove or disable access to allegedly infringing content consistent with applicable law.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

14. Limitation of Liability

To the maximum extent permitted by law, StreamGenie will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the Service. Our aggregate liability will not exceed the amounts you paid to StreamGenie for the Service in the twelve (12) months preceding the claim.

15. Indemnification

You will defend, indemnify, and hold harmless StreamGenie and its affiliates, directors, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

16. Termination

We may suspend or terminate your access to the Service at any time for any reason, including for violation of these Terms. Upon termination, the license granted to us with respect to your content will continue only as necessary for any archival, audit, or legal compliance purposes and otherwise will cease.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

18. Changes to the Service or Terms

We may modify the Service and these Terms from time to time. Material changes will be posted to the site or communicated to you. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
